These Terms of Service ("Terms") govern your use of hostr, a party planning application ("App") operated by Hostly LLC, an Indiana limited liability company ("Company," "we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
hostr is a free party planning application that allows users to create parties, manage guest lists, browse recipes, coordinate menus, share photos, and access grocery delivery services through third-party providers. The App is provided on an "as-is" and "as-available" basis.
You must be at least 18 years old to use hostr. By using the App, you represent that you are at least 18 years of age. We do not knowingly collect information from individuals under 13 years of age.
hostr does not require account registration. You access party features through shared links and your display name. You are responsible for maintaining the confidentiality of any host PINs or party links you create.
You may upload photos and other content to the App ("User Content"). You retain ownership of your User Content. By uploading content, you grant Hostly LLC a non-exclusive, royalty-free license to store, display, and distribute your User Content solely for the purpose of operating the App.

Party photos are automatically deleted 21 days after the party date. Party data (menus, guest lists, and other details) may be retained for a reasonable period after the party date. Users can delete their own parties at any time through the App.
The App integrates with third-party services including but not limited to Instacart, Amazon, Amazon Fresh, and Walmart for grocery delivery and shopping. These services are governed by their own terms of service and privacy policies. Hostly LLC is not responsible for the products, services, or practices of these third parties.
Some links within the App are affiliate links. We may earn a small commission from purchases made through these links at no additional cost to you.
The App, including its design, code, logos, and branding, is the property of Hostly LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HOSTLY LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTLY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL HOSTLY LLC'S TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Hostly LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

Any disputes arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in the State of Indiana, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms.
